Terms of Service

1. Merchant of Record (Paddle)

Our order process is conducted by our online reseller **Paddle.com**. Paddle.com is the Merchant of Record for all our orders. Paddle handles all payment-related customer service inquiries and returns. By purchasing a subscription or credit pack, you enter into a contract with Paddle.com and are subject to their terms of use.

2. Acceptance of Terms

By accessing or using the Flotense platform, website, or services (collectively, "the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.

3. The Service & Intelligence Credits

Flotense provides AI-driven social listening and discovery tools. Our service utilizes a dual-credit system:

  • Subscription Credits: Allocated monthly based on your selected plan. These credits reset at the start of each billing cycle and do not roll over.
  • Top-up Credits: Non-expiring credits purchased as one-time packs. These are consumed only after monthly subscription credits are exhausted.
  • Usage Definitions: A "credit" is consumed when the Service identifies a lead, enriches a comment with AI, or executes an automated discovery cycle.

4. Refund and Cancellation Policy

Subscriptions: You may cancel your subscription at any time. Your access will remain active until the end of the current billing period.

Refunds: We offer a 14-day money-back guarantee for unused credit packs and subscriptions. If you have not initiated any discovery missions or consumed any credits, you are eligible for a full refund. Once a discovery mission is initiated and credits are deducted, the service is considered "consumed" and non-refundable.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any local, state, national, or international law.
  • Harass, abuse, or spam individuals discovered through our platform.
  • Attempt to bypass API rate limits or security measures of our data providers (YouTube, Reddit, etc.).
  • Reverse engineer or attempt to extract the source code of the Flotense discovery engine.

6. Third-Party Data Providers

Our Service relies on third-party APIs. Your use of Flotense is also subject to the YouTube Terms of Service, Reddit User Agreement, and Twitter Developer Agreement. We are not responsible for changes to these third-party terms or API availability.

7. Intellectual Property

The Flotense name, logo, discovery algorithms, and dashboard UI are the exclusive property of Flotense Inc. You are granted a limited, non-exclusive license to use the Service for your internal business operations.

8. Dispute Resolution

Any disputes arising from these terms will be settled through binding arbitration. You agree to waive your right to participate in a class-action lawsuit or class-wide arbitration.
